MARK BOUNDARIES AND FENCING SURVEYS

When it comes time to replace a boundary fence, many people choose to have the boundary re-marked by a registered surveyor. There are benefits to having a boundary re-marked, particularly when there is a potential dispute between neighbours over the fence and boundary location.

It is important for land owners to understand where the boundary of their land is, whether or not the fence stands on that boundary. Often, the assumption is made that the location of the fence is the boundary between lots, however this is not necessarily the case. Particularly in rural situations, the fence may have been constructed as a “give and take” fence.

Where the boundary runs through rough terrain, fences are often constructed around the worst areas based on a verbal agreement between land owners at the time. Sometimes a “give and take” fence is a way to provide access, or just a convenient way to fence between neighbours. This does not change the location of the boundary.

When a registered surveyor is engaged to re-mark a boundary, the survey connects to survey marks that were placed in the original survey of the site. In some cases, where the original survey was 100 years ago or more, the survey may have to connect to marks remote to the site of the area to be re-marked, or to measure existing fences in the area in order to determine where the boundary is.

Legally, re-marking a boundary can only be done by a registered surveyor. Especially where there is a dispute between neighbours, a boundary re-mark survey is strongly recommended when a boundary fence is to be replaced.

The Dividing Fences Act 1991 (NSW) sets out how the cost of a dividing fence is to be shared between neighbours. If an owner wishes to replace a dividing fence, notice in writing should be served on the adjoining owner, otherwise there is no requirement for the adjoining owner to contribute towards the cost of replacing the fence.

If a surveyor is to be engaged, and the costs for the survey shared, this should be included in the fencing notice. It should be noted that some authorities, such as the local Council, roads authorities, and The Crown, do not have to contribute to the cost of fencing a boundary.
